Kurt Sauer is a senior counsel in the Commercial Litigation Division of Barron & Newburger, P.C. He practices out of the Austin office.

Experience

Mr. Sauer has tried cases throughout Texas for 40 years in state courts, federal courts, bankruptcy courts and before Texas state agencies. He has represented clients in many areas of commercial litigation, including accounting, banking, construction, employment, intellectual property, lending and lender liability, oil and gas, and real estate matters. He also has represented clients in litigation involving government agencies. Mr. Sauer regularly represents bankruptcy trustees and other parties in bankruptcy adversary proceeding litigation. Some of Mr. Sauer’s cases include:

  • Counsel for trustee of chapter 11 liquidation trust against accounting firm, actuarial firm, international auditing firm, consulting firm and reinsurance companies relating to bankruptcy of company selling automobile warranties. Litigation and resolution of case involved coordination with class action filed in California.
  • Counsel for trustee of creditor’s trust asserting claims against law firm for legal malpractice and violations of securities act concerning sale of oil and gas interests. Claims were asserted in conjunction with class action claims brought by investors residing in 35 states and two foreign countries.
  • Counsel for Texas-based inventor asserting patent infringement claims against fourteen national and international semiconductor manufacturers and retailers in multiple patent infringement cases concerning high capacitance structures in semiconductor devices.
  • Counsel for oil and gas company asserting claims to clear title and recover value of oil produced by company that claimed ownership through adverse possession of mineral interests.
  • Counsel for wrongfully convicted individual to recover damages for seven years wrongful imprisonment.
  • Counsel for professionals in disciplinary and licensing proceedings before Texas state agencies that license and regulate architects, attorneys, funeral home owners, mental health providers and peace officers.

Awards & Recognition

Mr. Sauer has served as Chairman of the City of Austin Airport Advisory Board. He has an AV Preeminent rating from Martindale-Hubbell Peer Review Rating and his pro bono work includes representation of clients in death penalty cases.

Personal

Mr. Sauer lives in downtown Austin with his partner, Laurie, a psychiatrist, and enjoys fishing, kayaking and the outdoors. In 2013-2014, Mr. Sauer and his family took a sabbatical and traveled around the world, with stays in Central America, South America, Europe, Africa, the Middle East, Asia and the United States. His son lives and works in Montana. His daughter attends college in Sewanee, Tennessee.
