Named partner Manny Newburger and Steve Sather were featured in a podcast produced by NARCA, the National Creditor’s Bar which aired shortly after the oral arguments in Case No. 16-348, Midland Funding, LLC v. Johnson.
The Midland Funding case addressed an issue which has caused great turmoil in the Bankruptcy Courts, whether a debt buyer violates the Fair Debt Collection Practices Act if it files a proof of claim that is barred by the applicable statute of limitations. The case addresses the intersection of two bodies of federal law, the Bankruptcy Code and the Fair Debt Collection Practices Act.
BNPC submitted an amicus brief on behalf of NARCA and Mr. Newburger was present at the Supreme Court to observe the oral argument on January 17, 2017. The podcast featured the impressions of Mr. Newburger, a noted FDCPA lawyer, and Mr. Sather, a bankruptcy practitioner, shortly after the oral arguments occurred. Mark Dobosz, Executive Director of NARCA, led the discussion.
